Sexual Orientation Is Specifically Defined In New Jersey To Include Bisexuality

New Jersey is one of the few places that specifically prohibits discrimination on the basis of gender identity. The New Jersey Law Against Discrimination defines "gender identity or expression" as "having or being perceived as having a gender-related identity or expression whether or not stereotypically associated with a person's assigned sex at birth." This provision was intended to make clear that transgender individuals — people who identify and/or express themselves as a gender different from their biological sex — cannot be subject to discrimination based on their gender identity. However, the statutory definition is so broad that it also protects heterosexual "effeminate men" and "masculine women" who do not identify themselves as being of the opposite gender, but are perceived that way. That is also a form of gender stereotyping.
